Dispute over cream's name: HUL gets interim relief against Emami

new Delhi. The Bombay High Court on Monday granted interim relief to Hindustan Unilever (HUL), asking FMCG company Emami that it would have to give notice to HUL seven days before it could start the legal process on the trademark. In fact, HUL recently removed the word 'Fair' from the name of Men's Skin Cream to 'Glow and Handsome', while Emami already makes skin cream under the name 'Glow and Handsome'. Justice BP Kolabwala was hearing a petition filed by HUL under the Trade Trademark Act. HUL had stated in its plea that the defendant (Emami) should give written notice to it at least seven days before the commencement of legal proceedings in any court.

The court, after hearing preliminary arguments, said that prima facie it appears that HUL already had this mark, as it had applied for its trademark first in September 2018 and then on 25 June 2020. The court said that the decision will be taken after hearing the arguments of both the parties on Emami's statement. The bench directed Emami to give written notice to HUL seven days before starting legal proceedings. The next hearing of the case will be held on 27 July.
